**Europe Has No Licensed Prediction Markets as ESMA Raises Regulatory Barriers**
European financial regulators have moved to restrict prediction markets before any platforms secured proper licensing in the region. On 3 July, ESMA warned that event contracts may fall under the EU’s existing retail ban on binary options, significantly complicating market entry for prediction platforms.
The crackdown follows national enforcement actions. Spain blocked Kalshi and Polymarket in May for operating without gambling licenses. Nine European gambling regulators, including those from France, Germany, and Belgium, issued a joint warning on 19 June against unlicensed platforms.
While prediction markets have boomed in the US under CFTC oversight, no major platform currently operates with European authorization. ESMA’s statement adds regulatory complexity by suggesting event contracts could be classified as financial instruments under MiFID II, triggering binary options restrictions beyond just gambling licenses. This creates a dual-classification hurdle that no business model has successfully navigated.
