According to Bloomberg, the regulator sent letters to all exchanges offering event contracts, stating that derivatives must be listed in nominal or percentage terms reflecting market pricing rather than sportsbook-style formats. The agency argues bookmaker presentation could mislead participants about the nature of their transactions and has cited research linking American odds to increased risk-taking behavior.
The directive arrives as prediction markets face intensifying jurisdictional battles between federal and state authorities. While platforms like Kalshi and Polymarket maintain their contracts are CFTC-regulated derivatives, multiple states have challenged sports-related event contracts as unlicensed gambling. All designated contract markets, futures commission merchants, and introducing brokers involved in prediction markets must acknowledge receipt by August 31.
